Labor rights


Basic rights of Mexican workers contained in article 123 of the Political Constitution of the United Mexican States. «Everyone has the right to decent and socially useful work»

  • The duration of the maximum day will be eight hours.
  • The maximum working night shift will be seven hours.
  • Unhealthy or dangerous work, industrial night work and all other work after ten o'clock at night, of those under sixteen years of age are prohibited.
  • The use of the work of children under fourteen is prohibited. Those over this age and under sixteen will have a maximum of six hours.
  • At least every day of work must be enjoyed by the operator at least one day of rest.
  • Women during pregnancy will not perform jobs that require considerable effort and pose a danger to their health in relation to pregnancy.
  • The general minimum wages must be sufficient to satisfy the normal needs of a head of family, in the material, social and cultural order, and to provide the compulsory education of the children.
  • Equal pay should correspond to equal work, regardless of sex or nationality.
  • The minimum wage will be exempt from garnishment, compensation or discount.
  • Workers will be entitled to a share in the company's profits.
  • The salary must be paid precisely in legal tender.
  • When the hours of the day are to be increased, one hundred percent more than what is fixed for normal hours shall be paid as salary for the excess time.
    Under no circumstances may extraordinary work exceed three hours per day, nor
    three consecutive times Children under sixteen years old will not be admitted to this kind of work.
  • Every company will be obliged to provide workers comfortable and hygienic rooms.
  • The companies will be obliged to provide their workers with training or job training.
  • Employers shall be liable for accidents at work and occupational diseases of workers, suffered as a result of or in the exercise of the profession or work they perform. This responsibility will subsist even if the employer hires the job through an intermediary.
  • The employer will be obliged to observe the legal precepts on hygiene and safety in the facilities of his establishment.
  • Both the workers and the businessmen will have the right to coalesce forming unions, professional associations, et cetera.
  • The laws will recognize strikes and strikes as a right of workers and employers.

The Mexican Official Standards of Safety and Health at Work, aims to make available to employers, workers, health and safety commissions, labor inspectors, private organizations, researchers and other interested parties, a computer tool that facilitates the search of the applicable regulations in the matter, according to the economic activity, scale and risk factors associated with the processes of each work center.

Likewise, the Assistant allows to know in an organized way the diverse requirements of the official Mexican standards of health and safety at work, grouped from a functional perspective in the following sections: studies, programs, procedures, security measures, recognition, evaluation and control , health monitoring, personal protection equipment, training and information, authorizations, and administrative records.

The Ministry of Labor and Social Welfare supports the dissemination of knowledge of the regulatory framework for the prevention of accidents and occupational diseases; it contributes to reducing the costs associated with the application of the official Mexican standards of the specialty, and provides essential information for surveillance and conformity assessment actions carried out by the federal labor inspection and private agencies, respectively.

NOM - 001 - STPS - 1994
Safety and hygiene conditions in buildings, premises, facilities and areas of work centers.

Objective: Establish safety and hygiene conditions.

Field of application: For the application, construction and conservation of work centers in a manner that avoids or diminishes the risks that these may constitute for the life and health of workers.

Objective: To prevent and protect the health of workers and improve safety and hygiene conditions where chemical substances are produced, stored or handled, which due to their properties, concentration levels and time of action are capable of contaminating the working environment and altering the health of the workers, as well as the maximum permissible levels of concentration of said substances, according to the type of exposure.

Safety and hygiene in work centers where noise is generated.

Objective and field of application: To improve the conditions of safety and hygiene where noise is generated by its characteristics, levels and time of action are capable of altering the health of workers, as well as the correlation between the maximum permissible levels of noise and the times permissible explosions per working day.

NOM - 018 - STPS - 1993
Requirements and characteristics of the services of showers, changing rooms and lockers in work centers.

Objective: To establish the requirements and characteristics in the installation of showers for the service of the workers and the general characteristics of the locker rooms and lockers.

Field of application: Where workers are exposed to skin contamination by chemical, irritant, corrosive or toxic substances and there is a risk of infection and irritation, there should be showers for workers' service, as well as locker rooms and lockers .
