Description.

Mandatory procedure that must be performed by all natural or legal persons, who carry out discharges of wastewater from industrial, commercial, service and agricultural activities that are discharged into drainage and sewerage systems.

They are established according to article 75 fraction I, paragraph 1, 3 and 4 of the Finance Law for the State of Tamaulipas.

 

For the services of Record of Discharge of Wastewater:

  1. For Microenterprise 12 times the daily value of the Measurement and Update Unit. Equivalent to: $ 967

 

  1. For Small Business. 96 times the daily value of the Measurement and Update Unit. Equivalent to Small: $ 7,738.00

 

 

  1. For Medium Business. 155 times the daily value of the Measurement and Update Unit. Equivalent to: $ 12,493.00
  2. For Big Company. 198 times the daily value of the Measurement and Update Unit. Equivalent to: $ 15,959.00

 

Per copy of Wastewater Discharge Records granted, 1 times the daily value of the Measurement and Update Unit. Equivalent to: $ 81.00

 

By change of company name, 3 times the daily value of the unit of measure and update. Equivalent to $ 242.00

Base requirements for all REDAR procedures.

 

Deliver original document of:

  • Free written request for the procedure to be performed (registration, update or withdrawal) addressed to the Secretary of Urban Development and Environment (with signature of the Legal Representative) in which you must expressly indicate an email for notifications. Include an additional copy for acknowledgment of receipt.
  • Application form for the Registration, Updating or Discharge of the State Register of Wastewater Discharges (REDAR) with the autograph signatures.
  • In case it applies, it can prove to the service provider, signed by the grantor and the one receiving the power, accompanied by two witnesses, with autograph signatures.

 

Deliver in original copy and show for comparison of:

  • Identification of the person who performs the procedure.
  • If applicable, Identification of the service provider, the one that grants the power and the two witnesses.
  • In the case of legal entities, present a constitutive act. Also include the accreditation and identification of the Legal Representative.
  • In the case of natural persons, present official identification of the owner of the company.

 

Copy or print of:

  • Tax Identification Card "or" Federal Taxpayer Registry (RFC) updated.
  • Proof of updated address, corresponding to the address of the requesting establishment.

 

 

Requirements for the registration request or update to the REDAR.

In addition to the base requirements, it should also include:

 

Copy or print of:

  • Descriptive writing of the productive process where wastewater discharges are generated.
  • Diagram of processes where the points where the water participates as an input and / or residual water are indicated.
  • Plan of distribution of the plant, including the areas, the distribution of the drainage network, sewers, treatments such as grease traps or others, in addition to the location of the wastewater discharges.
  • Plan and diagrams of water treatments, when applicable.
  • Last three water receipts.
  • Summary table that is part of the analysis report of discharge of wastewater dated no more than six months, which must be done by a laboratory certified by the Mexican accreditation entity (EMA). Include in the electronic file the complete report of wastewater discharge.

 

  • In case of requesting an update, a copy and original display must be submitted for comparison of the State Register of Wastewater Discharges to be updated.
  • The presentation to the Secretariat of compliance with the conditions imposed in the current resolution.

In addition to the base requirements, it should also include:

  • Accord circumstanced by closure of activities of the establishment, as applicable.

  • Photographic evidence of the elimination or closure of the download, as applicable.
  • The presentation to the Secretariat of compliance with the conditions imposed in the resolution with respect to which it requests a withdrawal.

Physically through the one-stop shop located on the ground floor of the Government Center of Bicentennial Park Offices with address at Praxedis Balboa and Libramiento Naciones Unidas in Ciudad Victoria, Tamaulipas.

Legal Basis:
Organic Law of the Public Administration of the State of Tamaulipas, in its articles 23 fraction XIII and 36 fraction II;

 

Article 12 of the Internal Regulation of the Secretariat of Urban Development and the Environment

 

Article 119 BIS fractions I, II and IV, of the General Law of Ecological Equilibrium and Environmental Protection;

 

Articles 27 paragraph 1, 103, 109 paragraph 1, 243, 244 paragraph 1, 246 paragraph 1 and 247 of the Code for Sustainable Development of the State of Tamaulipas;

 

Article 75 fraction I, paragraph 1, 3 and 4 of the Finance Law for the State of Tamaulipas, and;

 

Article 49 fraction II of the Law of Administrative Procedure of the State of Tamaulipas;

Resolution Criteria:
1.- All legal documentation must be presented as indicated in the requirements (original and copy for comparison) in the single window, and the documents issued by the petitioner must contain a handwritten signature of whoever intends to present them as their own. , for the respective procedure.

 

2.- Present the information in folders of three rings or engargolado; following the order established by the numerals and using separators that clearly distinguish what corresponds to each section. This will allow that during the reception and evaluation of your procedure no time is lost in the ordering of the file.

 

3.- The quality of the documents in the electronic must be legible and in true color (scanning of originals), at 200 ppp minimum, JPG or PDF format. Presentation on CD or USB.

 

4.- All information that is considered confidential for the company must be presented with a stamp that indicates "confidential information".

 

5.- In case of any faults or omissions in the requirements or in the information, the Secretariat will prevent the applicant in writing and only once to correct them in the terms of article 247 paragraph 1 of the Urban and Middle Development Code Environment, suspending the term that remains to conclude the procedure, in case you do not present this information will be discarded the process. In no case may the entire process exceed the term of 3 months, counted from the moment it is entered before the Secretariat, and provided that all the required information is delivered. If, at the end of the maximum response period, the authority has not responded, it will be understood that the request was resolved in a negative sense.

 

6.- Payments made independently of the result of the evaluation processes or of the positive or negative sense of the records of entry to the databases will not be subject to refund or accreditation, nor in the case of withdrawal or cancellation of the procedures by part of the interested party

 

7.- To deliver the resolution you must comply with the legal formalities required:

 

In case the person appearing is the legal representative of the company:

- Copy of valid official identification (IFE or INE, passport or driver's license);

In case the person appearing is another person:

- Simple, recent and original power of attorney signed by the legal representative of the company, 2 witnesses and from whom it appears;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the legal representative of the company;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the one who appears;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the 2 witnesses; Y

For both cases, if the legal representative is different from the one found in the files of this secretariat, it is necessary to attach a copy of the public deed containing the minutes of the meeting where the change of legal representative is recorded.

 

Present proof of payment for the tax rights that apply according to the type of resolution in electronic invoice that contains the CFDI (Digital Tax Proof for Internet). If you do not have an electronic invoice, you MUST SUBMIT THE PAYMENT PASS WITH TICKET ISSUED BY THE STATE'S FISCAL OFFICE. (Original and copy for comparison).
