Special Management Waste Management Plan


Description

The Management Plan is the instrument of integral management of the waste of special handling, which contains the set of actions and procedures to facilitate the handling and dispositions of consumer products that when disposed of become waste of special handling. Among the main objectives of the management plans are: to encourage the minimization of the generation of waste; promote the shared responsibility of producers, distributors and marketers; carry out the separation at the source, the separate collection of waste and encourage the reuse and recycling of solid waste, in order to reduce the volume and valorize the waste that currently goes to final disposal.

They must present their Management Plan, public and private bodies, deconcentrated bodies, delegations, entities of the public administration and individuals and morals that generate solid waste of special handling, as well as those commercial, industrial establishments.

FOR THE OBTAINING OF THE MANAGEMENT PLAN, IT SHOULD PREVIOUSLY CONTAIN WITH THE REGIME AS GENERATOR OF SPECIAL HANDLING RESIDUES (Mandatory procedure).

 

FOR THE FIRST TIME.

1.-Free document of request for processing addressed to the Secretary of Urban Development and Environment (with autographed signature of the Legal Representative) in which you must expressly indicate an email for notifications. Include an additional copy for acknowledgment of receipt.

 

2.- Application form for obtaining Management Plan with autograph signatures. (Downloadable format). (See resolution criteria).

 

3.- Legal and technical documentation:

- In the case of moral persons: (original and copy for comparison)

 

  1. Accreditation of the Legal Representative of the company.
  2. If applicable, accreditation of the service provider, signed by the legal representative and the one receiving the power, accompanied by two witnesses, with autograph signatures.
  3. If applicable, Identification of the service provider, the one that grants the power and the two witnesses.
  4. Company charter.
  5. Tax Identification Card "or" Federal Taxpayer Registry (RFC) updated.
  6. Copy or printed Proof of address of the company.

 

- In the case of natural persons:

  1. Original and copy for official identification of the owner of the company.
  2. Tax Identification Card "or" Federal Taxpayer Registry (RFC) updated.
  3. Copy or printed proof of current address of the company.

 

-For individuals and corporations:

  1. Registration as a generator of Special Management Waste. (original and copy for comparison).
  2. Document that contains the Management Plan.
  3. Copy of the current Authorizations of the companies in charge of the integral management (recycling, reuse, collection, collection and transport, etc.) of the waste of special handling generated.
  4. Annex sketch of the company's location.
  5. An electronic backup of all the information presented. (See Resolution criteria)

 

4.- In case there is any doubt about the hazardousness or not of the waste, it must be subject to the hazard identification procedure, through CRETI analysis (Corrosive, Reactive, Explosive, Toxic, Flammable) and CRETIB analysis (Corrosive, Reactive, Explosive , Toxic, environmentally and Biologically Infectious) according to the waste, in accordance with NOM-52-SEMARNAT 2005 or NOM-004-SEMARNAT-2002, as appropriate. (Original and copy for collateral in one-stop shop or, where appropriate, certified copy).

Legal Basis:
 

Article 9 fractions I, III, IV and VI, 28 fraction III, 95 and 98 of the General Law for the Prevention and Integral Management of Residues; articles 125, 126, 127, 129 and 140 fraction II of the Code for the Sustainable Development of the State of Tamaulipas; Articles 1, 13, 14, 16, 17 and 19 of the Regulation of Prevention and Management of Waste of Special Management for the State of Tamaulipas.

 

 

Resolution Criteria:
1.- All legal documentation must be presented as indicated in the requirements (original and copy for comparison) in the single window, and the documents issued by the petitioner must contain a handwritten signature of whoever intends to present them as their own. , for the respective procedure.

 

2.- Present the information in folders of three rings or engargolado; following the order established by the numerals and using separators that clearly distinguish what corresponds to each section. This will allow that during the reception and evaluation of your procedure no time is lost in the ordering of the file.

 

3.- The quality of the documents in the electronic must be legible and in true color (scanning of originals), at 200 ppp minimum, JPG or PDF format. Presentation on CD or USB.

 

4.- All information that is considered confidential for the company must be presented with a stamp that indicates "confidential information".

 

5.- In case of any faults or omissions in the requirements or in the information, the Secretariat will prevent the applicant in writing and only once to correct them in the terms of article 247 paragraph 1 of the Urban and Middle Development Code Environment, suspending the term that remains to conclude the procedure, in case you do not present this information will be discarded the process. In no case may the entire process exceed the term of 3 months, counted from the moment it is entered before the Secretariat, and provided that all the required information is delivered. If, at the end of the maximum response period, the authority has not responded, it will be understood that the request was resolved in a negative sense.

 

6.- To deliver the resolution you must comply with the legal formalities required:

 

In case the person appearing is the legal representative of the company:

- Copy of valid official identification (IFE or INE, passport or driver's license);

In case the person appearing is another person:

- Simple, recent and original power of attorney signed by the legal representative of the company, 2 witnesses and from whom it appears;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the legal representative of the company;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the one who appears;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the 2 witnesses; Y

- For both cases, if the legal representative is different from the one found in the archives of this secretariat, it is necessary to attach a copy of the public deed that contains the minutes of the meeting where the change of legal representative is recorded.
