1.- Present in a Single Window of the Undersecretary of the Environment the free written application for the Environmental Impact study signed by the Legal Representative of the company or promoter, which must mention the type of study presented, the name and the physical location of the project and telephone, and deliver it in a three-hole plastic folder.

2.- You are required to expressly indicate any means of electronic communication (mail) for the purpose of making your notifications in accordance with Article 49 section II of the Administrative Procedure Law of the State of Tamaulipas.

3.- Present the printed Format corresponding to the type of Environmental Impact Study to be evaluated in Spanish, including the technical, legal annexes, cartographies and definitive plans authorized by the competent authority, at appropriate, legible scales and bounded in meters. The study must be signed by the Legal Representative of the company and by the person responsible for the preparation of the project.

 

4.- All legal documentation must be submitted in original and copy for your comparison in Single Window, being this the following one:

  • Company charter,
  • Tax Identification Card "or" Federal Taxpayer Registry (RFC) updated. (printed).
  • Proof of address of the business,
  • Accreditation and Identification of the Legal Representative,
  • Accreditation and Identification of the Service Provider and / or Technical Manager, signed by both parties and accompanied by two witnesses, with autograph signatures.

 

5.- Present original and copy of the pass of payment and ticket for fiscal rights for the entrance and evaluation of the Study of Environmental Impact duly liquidated. (Request it from the Secretariat of Urban Development and the Environment, by e-mail: impact.ambiental@tamaulipas.gob.mx.

6.- Authorization of Land Use (License and / or feasibility) in original and copy for comparison.

7.- Legal instrument that proves the ownership of the property, which must be duly notarized, in case the property is owned by the company that will perform this management, must submit a document (lease agreement, assignment of rights, loan agreement) duly certified before a Notary Public, in such a way that the consent of the owner is guaranteed, so that the property requested is granted on the property, likewise said document must contain a clause detailing location, area and activity which is intended to be carried, said document must be presented in original and copy to be acknowledged receipt. Or if appropriate, be duly certified before a Notary Public.

8.- Submit three copies in electronic format that include the Environmental Impact Study, the legal documentation, plans, figures and technical annexes of agreements to the type of work and / or projected activity and a copy in electronic format with the legend "public version »

Legal Basis:
Environmental Impact Manifestation General modality: Articles 56, 57, 58, 60, 61, 62, 63, 64, 65, and 67 of the Code for the Sustainable Development of the State of Tamaulipas and article 14 paragraph 1 fraction I of the Regulation of Evaluation of the Environmental Impact for the State of Tamaulipas.

Environmental Impact Manifestation Urban modality: articles 56, 57, 58, 60, 61, 62, 63, 64, 65 and 67 of the Code for Sustainable Development of the State of Tamaulipas and articles 14 paragraph 1 fraction ii and 15 of the Evaluation Regulation of the Environmental Impact for the State of Tamaulipas.

Preventive Report: article 59 of the Code for the Sustainable Development of the State of Tamaulipas and the articles 35, 36, 37 and 38 of the Regulation of Environmental Impact Assessment for the State of Tamaulipas.

Environmental Damage Study: articles 269, 270, 271, 272, 273, 274, 275, 276 and 277 of the Code for Sustainable Development of the State of Tamaulipas.

Environmental Risk Study: articles 56 paragraph 4, 57 paragraphs 3 and 4, 58, 113 and 114 of the Code for Sustainable Development of the State of Tamaulipas and articles 14 paragraph 1 fraction iii and 16 of the Regulation of Environmental Impact Assessment for the State of Tamaulipas

 

Resolution Criteria:
1.- All legal documentation must be presented in original and copy for comparison in the one-stop shop, and the documents issued by the promoter must contain a signature of whoever intends to present them as their own, for the respective procedure.

 

2.- Present the information in folders of three rings or engargolado; following the order established by the numerals and using separators that clearly distinguish what corresponds to each section. This will allow that during the reception and evaluation of your procedure no time is lost in the ordering of the file.

 

3.- The quality of the documents in the electronic must be legible and in true color (scanning of originals), at 200 ppp minimum, JPG or PDF format. Presentation on CD or USB.

 

4.- All information that is considered confidential for the company must be presented with a stamp that indicates "confidential information".

 

5.- When the writings submitted by the interested parties do not contain the data or do not comply with the applicable requirements, the Secretariat will prevent the petitioner in writing and only once to remedy the omission, which can be remedied under the terms of the article 247 paragraph 1 of the Code for Urban Development and Environment, and the term for the agency to resolve the procedure will be suspended and will resume as of the working day immediately following that in which the interested party answers and in case it does not present said information will be discarded.

 

6.- The Secretariat will resolve within a period of sixty working days from the reception of the document, except in exceptional cases in which, due to the complexity and dimensions of the project, an extension of the term for its evaluation is agreed, for a period of time Likewise, you must notify when promoting the justification of your agreement.

 

7.- For the delivery of the resolution to release the audit, you must comply with the legal formalities required:

 

- If the person appearing is the legal representative of the company:

- Copy of valid official identification (IFE or INE, passport or driver's license);

 

- In case the person appearing is another person:

- Simple, recent and original power of attorney signed by the legal representative of the company, 2 witnesses and from whom it appears;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the legal representative of the company;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the one who appears;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the 2 witnesses; Y

- For both cases, if the legal representative is different from the one found in the archives of this secretariat, it is necessary to attach a copy of the public deed that contains the minutes of the meeting where the change of legal representative is recorded.

 

Payment of tax rights for income and evaluation of the Environmental Impact Study or electronic invoice containing the CFDI (Digital Tax Proof for Internet). In the case of not having electronic invoice, SHOULD PRESENT THE PAYMENT PASS WITH TICKET ISSUED BY THE STATE'S FISCAL OFFICE, (Original and copy for comparison).

 

8.- Payments made independently of the result of the evaluation processes or of the positive or negative sense of the records of entry to the databases will not be subject to refund or accreditation, nor in the case of withdrawal or cancellation of the procedures by part of the interested party

 

9.- The Secretariat will conduct verification visits to corroborate the information presented.

 

10.- Payment of tax rights for the environmental impact resolution or electronic invoice that contains the CFDI (Digital Tax Receipt for Internet). In the case of not having electronic invoice, SHOULD PRESENT THE PAYMENT PASS WITH TICKET ISSUED BY THE STATE'S FISCAL OFFICE, (Original and copy for comparison).

 

If, at the end of the maximum response period, the authority has not responded, it will be understood that the request was resolved in a negative sense.
