FOR REUSE: Mandatory procedure that must be performed by any individual or company that has commercial establishments and / or services related to the stages of the integral management of the waste of special handling and that used a previously used material or waste, without a mediation. Transformation proccess.

FOR RECYCLING: Mandatory procedure that must be performed by any natural or legal person that has commercial establishments and / or services related to the stages of the integral handling of the residues of special handling and that transforms the waste into new products, in such a way that the Original waste loses its identity and becomes raw material for new products.

  1. A) BASE REQUIREMENTS:

 

1.- Free document of the request for the procedure to be addressed to the Secretary of Urban Development and the Environment (with the signature of the Legal Representative) in which he must expressly indicate an email for notifications. Include an additional copy for acknowledgment of receipt.

3.- Legal and technical documentation:

 

-License of Land Use compatible with the activities to be carried out (storage, storage, co-processing, treatment, recycling and final disposal of special handling waste).

 

- In the case of moral persons: (original and copy for comparison).

  1. a) Accreditation of the Legal Representative of the company.
  2. b) If applicable, accreditation of the service provider, signed by the legal representative and the one receiving the power, accompanied by two witnesses, with autograph signatures.
  3. c) If applicable, Identification of the service provider, of the one that grants the power and of the two witnesses.
  4. d) Constitutive act of the company.
  5. e) Tax Identification Card "or" Federal Taxpayer Registry (RFC) updated.
  6. f) Copy or printed Proof of address of the company.

 

- In the case of natural persons:

  1. a) Original and copy for official identification of the owner of the company.
  2. b) Tax Identification Card "or" Federal Taxpayer Registry (RFC) updated.

FOR THE FIRST TIME:

  1. Current contingency attention program endorsed by State Civil Protection and / or Insurance that covers the repair for civil liability and environmental restoration of the property, in original and copy for comparison in Single Window.

  4. Training program for personnel that will intervene in the handling of special handling waste.
  5. Copy of the plan of the executive project of the plant as a whole, which must indicate the distribution of the areas, including the storage or collection of each of the special handling waste received for its management and the special handling waste management area. , as it is.
  6. Diagram of the process of integral handling of the residues of special handling.
  7. If there is any doubt about the hazardous characteristics of the waste, it must be subjected to the identification procedure by means of CRETI analysis (Corrosive, Reactive, Explosive, Toxic, Flammable) or CRETIB analysis (Corrosive, Reactive, Explosive, Toxic, Environmentally and Biologically) Infectious) according to the residue, according to NOM-052-SEMARNAT-2005.

Resolution Criteria

 

1.- Present in a Single Window of the Undersecretary of the Environment the free document requesting the procedure that is to be addressed to the Secretary of Urban Development and the Environment (with the signature of the Legal Representative) in which he must expressly indicate any means of electronic communication (mail) for the purpose of making their notifications in accordance with Article 49 section II of the Administrative Procedure Law of the State of Tamaulipas., as well as the person (s) authorized to hear and receive notifications .

 

2.- All legal documentation must be presented in original and copy for comparison in the one-stop shop, and the documents issued by the promoter must contain a signature of whoever intends to present them as their own, for the respective procedure.

 

3.- Present the information in folders of three rings or engargolado; following the order established by the numerals and using separators that clearly distinguish what corresponds to each section. This will allow that during the reception and evaluation of your procedure no time is lost in the ordering of the file.

 

4.- The quality of the documents in the electronic should be in true color (scanning of originals), at 200 ppp minimum, JPG or PDF format. Presentation on CD or USB.

 

5.- The Secretariat will conduct verification visits to corroborate the information presented.

 

6.- The Secretary will prevent the applicant, if there are faults or omissions in the requirements or in the information, which can be corrected in the granted terms, in case it does not present said information the procedure will be rejected.

 

7.- All information that is considered confidential for the company must be presented with a stamp indicating "confidential information

9.- FOR THE DELIVERY OF THE RESOLUTION.

It must comply with the legal formalities required by the Legal Subdirectorate of this Secretariat.

 

In case the person appearing is the legal representative of the company:

- Copy of valid official identification (IFE or INE, passport or driver's license);

- In case of someone appearing, another person:

- Simple, recent and original power of attorney signed by the legal representative of the company, 2 witnesses and from whom it appears;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the legal representative of the company;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the one who appears;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the 2 witnesses; Y

- For both cases, if the legal representative is different from the one found in the archives of this secretariat, it is necessary to attach a copy of the public deed that contains the minutes of the meeting where the change of legal representative is recorded.

 

If, at the end of the maximum response period, the authority has not responded, it will be understood that the request was resolved in a negative sense.
