Cost Requirements
Sections XVIII of the Finance Law for the State of Tamaulipas are established in accordance with article 75.

For the reception, evaluation and resolution of the authorization for a temporary storage or for a waste collection center for handling waste of special handling. 20 times the daily value of the Measurement and Update Unit. Equivalent to $ 1,612.00

All the documents required in this procedure must be presented in original and copy for comparison in the Single Window of the Undersecretary of the Environment.

 

  1. BASE REQUIREMENTS:

 

1.- Free document of the request to be processed (registration, update or deregistration) addressed to the Secretary of Urban Development and Environment (with the signature of the Legal Representative) in which he must expressly indicate an email for notifications. Include an additional copy for acknowledgment of receipt.

 

2.- Application form for the Authorization for temporary storage or special handling waste collection center. (Downloadable formats).

 

3.- Legal and technical documentation:

- In the case of moral persons: (original and copy for comparison).

  1. Accreditation of the Legal Representative of the company.
  2. If applicable, accreditation of the service provider, signed by the legal representative and the one receiving the power, accompanied by two witnesses, with autograph signatures.
  3. If applicable, Identification of the service provider, the one that grants the power and the two witnesses.
  4. Company charter.
  5. Tax Identification Card "or" Federal Taxpayer Registry (RFC) updated.
  6. Copy or printed Proof of address of the company.
  7. Land Use License compatible with the activities to be carried out (storage, storage, co-processing, treatment, recycling and final disposal of special handling waste).

 

- In the case of natural persons:

  1. Original and copy for official identification of the owner of the company.
  2. Copy or printed form of the Tax Identification Card "or" Federal Taxpayer Registry (RFC) updated.
  3. Copy or printed proof of current address of the company.

 

-For individuals and corporations:

  1. Payment of tax rights for the receipt, evaluation and resolution of the authorization in electronic invoice containing the CFDI (Digital Tax Receipt via Internet). In the case of not having electronic invoice, SHOULD PRESENT THE PAYMENT PASS WITH TICKET ISSUED BY THE STATE'S FISCAL OFFICE, (Original and copy for comparison).
  2. Electronic backup of all the documents required for the procedure, as the case may be. (See resolution criteria)
  3. Legal Instrument with which proves the ownership of the property, which must be duly notarized. (Original and copy for comparison)
  4. Contingency assistance program endorsed by State Civil Protection or Insurance that covers reparation for civil liability and environmental restoration of the property.

 

FOR THE FIRST TIME:

In addition to the documents required in subsection A, the following must also be included:

FOR EXTENSION:

In addition to the documents required in subsection A, the following must also be included:

 

  1. Compliance with each and every one of the conditions established in the authorization requested is extended. (copy).

 

  1. Certificate and prior Authorization of the authorization for temporary storage or collection center for special handling waste. (copy)

 

  1. Payment of prior rights in electronic invoice that contains the CFDI (Digital Tax Receipt for Internet). In the case of not having an electronic invoice, MUST SUBMIT THE PAYMENT PASS WITH TICKET ISSUED BY THE STATE'S FISCAL OFFICE, (copy).

 

FOR WASTE EXPANSION:

Before concluding the validity of your authorization, you must include the following:

  1. Present in a Single Window of the Undersecretary of the Environment a free written request for the extension of special handling waste, addressed to the Secretary of Urban Development and the Environment (with the signature of the Legal Representative) in which he must expressly indicate any means of electronic communication (mail) for the purpose of making your notifications.
  2. Description of the waste, where it indicates: the name of the waste, the surface in square meters (m2), the estimated annual amount of handling, the form of storage, storage capacity, form of packaging, origin and final destination.
  3. Management or process to which the waste of special handling will be subject from when they arrive at the facilities, machinery and equipment to be used.

4. Sketch of the location of the areas destined for the waste that you request to add to your authorization.

Legal Basis
Articles 7 section VI of the General Law of Ecological Equilibrium and Protection of the Environment; article 9 fractions I, III, IV and VI, 95, 96 fraction I, VIII and IX of the General Law for the Prevention and Integral Management of Waste; articles 1 fraction II, 120 fraction XIII, 134 paragraph 1, 135, 143 paragraph 1 fractions V and VII, 144 paragraph 1 and 3, 145 and 146 of the Code for the Sustainable Development of the State of Tamaulipas, articles 6 fraction IV, 20 fraction IV, 25 paragraph 2, 36, 38, 39 and 40 of the Regulation of Prevention and Integral Management of the Wastes of Special Management for the State of Tamaulipas.

 

Resolution Criteria
 

1.- Carry out the payment for corresponding fiscal rights for the concept of receipt, evaluation and resolution of the authorization for temporary storage or for waste collection center for handling waste of special handling. Which does not constitute an authorization at any time.

 

2.- All legal documentation must be presented in original and copy for comparison in the one-stop shop, and the documents issued by the promoter must contain an autographed signature of whoever intends to present them as their own.

 

3.- Present the information in folders of three rings or engargolado; following the order established by the numerals and using separators that clearly distinguish what corresponds to each section. This will allow that during the reception and evaluation of your procedure no time is lost in the ordering of the file.

 

4.- The quality of the documents in the electronic should be in true color (scanning of originals), at 200 ppp minimum, JPG or PDF format. Presentation on CD or USB.

 

5.- In the event that the ownership of the property is not property of the company or promoter it must submit a document (lease agreement, assignment of rights, loan agreement) duly certified before a Notary Public, in such a way that it is protected the consent of the owner, so that on the property the requested authorization is granted, also said document must contain a clause detailing, location, surface and activity that it intends to carry.

 

6.- Those promoters who have their authorization for Temporary Storage or Collection Center of RME, and who do not comply with the provisions of Article 40 of the Regulation of Prevention and Comprehensive Management of Special Management Waste for the State of Tamaulipas, shall request a new authorization, including the last authorization with which they have, proof of payment for the fiscal rights in original and copy, or electronic invoice and compliance with conditions of the previous authorization.

 

7.- All information that is considered confidential for the company must be presented with a stamp that indicates "confidential information".

 

8.- The Secretariat will prevent the petitioner in writing and only once to remedy any errors or omissions in the requirements or information, which can be corrected in the terms of article 247 paragraph 1 of the Code for the Urban Development and Environment, in case you do not present this information, the procedure will be rejected.

 

9.- For the delivery of the resolution to release the audit, you must comply with the legal formalities required:

 

In case the person appearing is the legal representative of the company:

- Copy of valid official identification (IFE or INE, passport or driver's license);

- In case of someone appearing, another person:

- Simple, recent and original power of attorney signed by the legal representative of the company, 2 witnesses and from whom it appears;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the legal representative of the company;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the one who appears;

- Copy of valid official identification (IFE or INE, passport or driver's license) of the 2 witnesses;

For both cases, if the legal representative is different from the one found in the files of this secretariat, it is necessary to attach a copy of the public deed containing the minutes of the meeting where the change of legal representative is recorded.

 

10.- Payments made independently of the result of the evaluation processes or of the positive or negative sense of the records of entry to the databases will not be subject to refund or accreditation, nor in the case of withdrawal or cancellation of the procedures by part of the interested party

 

11.- The Secretariat will conduct verification visits to corroborate the information presented.

 

If, at the end of the maximum response period, the authority has not responded, it will be understood that the request was resolved in a negative sense.
